These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Zizapay LLC (“Zizapay,” “we,” “us,” or “our”). By accessing our website, mobile application (the “App”), or using our remittance services, you agree to be bound by these Terms.
1. Regulatory Status and Compliance
Zizapay LLC is a registered Money Services Business (MSB) with the Financial Crimes Enforcement Network (FinCEN). We operate under strict adherence to the Bank Secrecy Act (BSA) and applicable state-level money transmitter regulations.
1.1 Anti-Money Laundering (AML) & KYC
To prevent financial crime, Zizapay maintains a robust AML and Know Your Customer (KYC) program. Under federal law, we are required to:
- Verify Identity: Collect and verify your full legal name, date of birth, physical address, and government-issued identification such as a passport or state ID.
- Monitor Transactions: Analyze transaction patterns to detect and report suspicious activity.
- Source of Funds: Request documentation regarding the origin of funds for high-value or unusual transactions.
2. Eligibility and Account Registration
To use Zizapay you must:
- Be at least 18 years of age
- Be a resident of a supported jurisdiction such as the United States or Canada
- Provide accurate, current, and complete information during registration
- Not be a person barred from receiving services under United States law or international sanctions programs including OFAC lists
3. Scope of Services
Zizapay provides a cross-border payment platform focused on the African and Caribbean diaspora. Services include:
- Remittance: Sending funds to individuals in supported countries
- Direct Utility Payments: Paying for electricity, water, and essential services for beneficiaries
- Airtime & Data: Instant mobile top-ups
- Subscription Management: Managing recurring payments for family-related services abroad
4. Transaction Limits and Verification
To comply with FinCEN regulations, Zizapay imposes limits on the amount of money users can send.
- Tiered Limits: Sending limits are determined by the level of identity verification completed.
- Enhanced Due Diligence (EDD): High-value transactions may require additional documentation such as proof of income or business registration.
- Refusal of Service: Zizapay may delay, block, or cancel any transaction suspected of violating AML or counter-terrorism financing regulations.
5. Fees and Exchange Rates
No-Fee Transfers: Where advertised, Zizapay may provide zero-fee remittance services. We reserve the right to modify fee structures with prior notice.
Exchange Rates: Zizapay generates revenue through a spread applied to the exchange rate. The applicable rate will be clearly displayed before confirming a transaction.
Third-Party Charges: Zizapay is not responsible for fees charged by recipient banks, financial institutions, or mobile wallet providers.
6. Error Resolution and Refunds
6.1 Right to Refund
Under the Consumer Financial Protection Bureau (CFPB) Remittance Transfer Rule, you have the right to cancel a transfer within 30 minutes of payment for a full refund provided the funds have not yet been collected or deposited.
6.2 Error Reporting
If you believe there is an error such as an incorrect recipient or transfer amount, you must contact Zizapay Support within 180 days of the transaction date. We will investigate and respond within 90 days.
7. Prohibited Activities
- Illegal Acts: Activities involving drugs, weapons, or human trafficking
- Fraud: Using stolen credentials or engaging in phishing schemes
- Structuring: Attempting to bypass regulatory reporting thresholds by splitting transactions
- Commercial Resale: Using a personal account for commercial money transmission without authorization
8. Data Privacy and Security
Your privacy is governed by the Zizapay Privacy Policy. By using our services, you consent to the collection and processing of biometric data for identity verification and the sharing of relevant information with international partners strictly for transaction execution and regulatory compliance.
9. Limitation of Liability
To the maximum extent permitted by law, Zizapay shall not be liable for indirect, incidental, or consequential damages resulting from:
- Technical failures beyond our control
- Delays caused by regulatory reviews or banking partners
- Errors made by the user such as incorrect recipient details
10. Termination of Account
Zizapay may suspend or terminate your account immediately if:
- You breach these Terms
- We are required to do so by law or government authority
- Account activity poses a high risk of fraud or money laundering
